Acceptance of Terms

These Terms and Conditions form a legally binding agreement between you ("you", "your", the "User", the "Host" or the "Guest") and Ariam Lawyers Pty Ltd (ACN: 664 520 772) trading as Park My Rig (ABN: 50 664 520 772) ("we", "us", "our", or the "Company") which governs your use of this website (parkmyrig.com.au) (the "Website") and our services.

By clicking "I ACCEPT", you register as a user of Park My Rig and you enter a legally binding agreement with Park My Rig on the following terms. You warrant that you have full legal capacity to enter into this agreement. If you do not accept all the Terms and Conditions you must not use or access the Website.

Park My Rig reserves the right to amend these Terms and Conditions from time to time without notice. You will be deemed to have read and accepted these Terms and Conditions, including any changes, each time you use the Website.

Definitions

For the purposes of these Terms and Conditions:

  • Host means the person advertising via the Website and providing a Parking Space for the Guest to park their vehicle
  • Parking Space means the physical parking space, driveway, yard, or other location at the Host's address where vehicles are parked under a Booking Agreement
  • Guest means the person paying the Total Fee and utilising a Parking Space to park their vehicle
  • Listing means an advertisement or post on the Website offering a Parking Space for parking vehicles
  • Booking Agreement means Agreement between a Host and a Guest to utilise a Parking Space for parking a vehicle for a Total Fee
  • Vehicle means caravans, boats, trailers, motorhomes, RVs, or other recreational vehicles to be parked under a Booking Agreement
  • Total Fee means the aggregate of Parking Fee and Platform Commission
  • Parking Fee means the listing price applied by a Host for the use of a Parking Space
  • Platform Commission means fee paid to Park My Rig calculated as 10% (including GST) of the Total Fee
  • Security Bond means a payment deposit that may be set by the Host to cover potential damage to the Parking Space or access devices
  • Prohibited Vehicles means vehicles that may not be parked through a Booking Agreement including vehicles containing hazardous materials, illegal substances, unregistered vehicles, or vehicles leaking fluids

General Conditions

Park My Rig makes available a platform or marketplace with related technology for Guests and Hosts to list, quote and arrange for bookings of parking spaces. The Company is not a parking agent or property broker. Park My Rig acts as an intermediary for members to transact and is not considered a party to any Booking Agreement between the Host and the Guest.

We reserve the right to close your account or to remove or disable access to any Listing for any reason, including Listings that Park My Rig, in its sole discretion, considers to be objectionable for any reason, in violation of these Terms.

The laws of the State of Victoria, Australia apply to these Terms and Conditions and the parties submit exclusively to the courts of that jurisdiction.

User Registration and Obligations

Registration with the Website requires the User to supply your name, email address and a password. Once registered your email address and password constitute the "Registration Details" of your User account.

When you create a user account, we may require you to verify your identity. You warrant that all identity documents you provide are complete, current and accurate. You undertake to notify us of any changes to these identity documents within 7 days.

Each Listing by a Host is an offer to enter a legally binding Booking Agreement with the Guest. If the Guest indicates through the website that the proposed terms of the Listing are accepted, the Host will receive by email the booking request, to which they must respond within 48 hours. In the absence of response, the request is considered rejected.

Host Obligations

To create a Listing, the Host must describe the Parking Space, along with any conditions they wish to apply, on the listing page of the Website. Such description should include details like size, location, security features, access arrangements, vehicle restrictions, and any special conditions. The Host will also set the price they wish to charge for parking. All descriptions and information must be accurate, complete, up-to-date and truthful.

You acknowledge and agree that you are responsible for any and all Listings you post. You represent and warrant that any Listing you post will not breach any agreements you have entered into with any third parties and will be in compliance with all applicable laws, including zoning laws and strata regulations.

Hosts agree to never request that a Guest pay any Parking Fees directly to the Host outside of the Park My Rig platform.

You acknowledge and agree that Park My Rig must comply with all laws including Australian Taxation Office (ATO) reporting requirements. By using our website, you authorise us to provide information to the ATO as required by law.

Guest Obligations

By entering into a Booking Agreement with a Host you warrant that you will only use the Parking Space for parking your Vehicle, you are not parking Prohibited Vehicles, and will not use the Parking Space for any unlawful purpose.

The Guest undertakes to pay the Total Fee promptly and in full using the online payment system upon confirmation of the Booking Agreement.

The Guest will comply with access and security arrangements and keep safe any keys or access devices provided by the Host.

At or before the end of the booking period, the Guest must remove their Vehicle completely and leave the Parking Space in the same condition as when they arrived.

Payment and Fees

Upon acceptance of a Booking Agreement, Park My Rig will collect Total Fees from the Guest. All financial transactions will be processed through our secure payment system.

Total Fees consist of the Parking Fee and Platform Commission. Park My Rig will pay the Parking Fee less the Platform Commission to the Host within five (5) business days of the booking start date.

For bookings longer than one month, Guests will be charged monthly Total Fees on a recurring basis, collected five (5) days before each new monthly period begins.

Cancellation Policy

24-Hour Money Back Guarantee: Either party (Host or Guest) may cancel the Booking Agreement without penalty within 24 hours of the booking confirmation.

Guest Cancellations:

  • More than 48 hours before arrival: Full refund minus processing fees
  • 24-48 hours before arrival: 50% refund
  • Less than 24 hours before arrival: No refund
  • Emergency circumstances: May be considered for partial refund at Park My Rig's discretion

Host Cancellations:

  • More than 7 days before arrival: No penalty
  • Less than 7 days before arrival: Host forfeits Parking Fee and may face account restrictions
  • Emergency circumstances: May be considered without penalty

Long-term Booking Cancellations: For bookings longer than one month, either party must provide one (1) month written notice to terminate, and fees apply for the full notice period.

Vehicle Insurance and Liability

Guests must maintain comprehensive insurance on their Vehicle and provide proof if requested by the Host.

Hosts are responsible for maintaining appropriate property insurance and should inform their insurer about hosting parking arrangements.

Park My Rig does not provide insurance coverage for Vehicles or Parking Spaces. All arrangements are made at the users' own risk.

Guests are liable for any damage caused to the Parking Space by their Vehicle or actions.

Prohibited Uses

The following are strictly prohibited:

  • Parking Prohibited Vehicles
  • Using Parking Spaces for storage of goods (unless specifically agreed)
  • Subletting or transferring bookings without consent
  • Interfering with neighboring properties
  • Any illegal activities

Hosts may immediately terminate a Booking Agreement if Prohibited Vehicles or activities are discovered.

Dispute Resolution

Park My Rig encourages users to resolve disputes directly. If unable to resolve, users may contact our support team at support@parkmyrig.com.au.

For unresolved disputes, parties agree to attempt mediation before pursuing legal action.

Limitation of Liability

Park My Rig provides the Website and Services on an "as is" and "as available" basis. We exclude all warranties not expressly stated in these Terms.

All Booking Agreements between users are carried out entirely at your own risk. Park My Rig excludes liability for any claims arising from arrangements between users.

You agree to indemnify Park My Rig from any claims arising from your breach of these Terms and Conditions.

Privacy and Data Protection

Park My Rig has a Privacy Policy which forms part of these Terms and Conditions. You must read and agree to the Privacy Policy prior to using the Website.

All users must treat information obtained through the platform as confidential and use it only for the purpose of arranging parking through Park My Rig.

Tax Obligations

You are solely responsible for determining your tax reporting requirements in consultation with your tax advisors.

As a Host, income earned through Park My Rig may be considered taxable income by the ATO. Consult with your accountant regarding tax obligations and potential deductions.

Hosts are responsible for managing their own GST obligations where applicable.

Intellectual Property

The Website and all intellectual property belonging to Park My Rig remains our property and is protected under copyright laws.

When you upload content to the Website, you grant Park My Rig a license to use that content for the purposes of operating the platform.

Account Termination

Park My Rig may terminate or suspend your account at any time for breach of these Terms and Conditions.
